New Amendments Following Reform of New Bankruptcy Laws

Forms Southern District Bankruptcy Court New York

Questions about electronic case filing (computer format requirements) may be answered by the ECF help desk - by telephone. Also, the court's website provides a general summary of Chapter 7 and Chapter 13 requirements, new forms required, and general court access information. The court also warns all debtors: "Regular business hours for users' support and filings on the court's Electronic Filing System are from 8:30 A.M. to 5:00 P.M., Eastern time. Although the New York bankruptcy online system is available 24 hours per day, 7 days per week, it may be necessary for the court to interrupt service for maintenance. Please be aware that if you choose to file at hours other than the supported time you may experience the interruption of service."

The majority of Southern District Courts allow either electronic filing or paper filing. A small number of these courts permit only electronic filing. Likewise, a small number of courts only permit paper form filings. The trend however is clear: all Southern District Courts will eventually accept only an approved electronic filing format and will probably continue to accept diskettes at the clerk's office rather than requiring only online submission. The goal adopted by the Southern District seems to require the elimination of paper documents by 2010.

Daily operation and administration procedures for New York Bankruptcy Courts are determined by the Administrative Office of US Courts. The judicial power of Judges is determined by Federal Law, which is derived primarily from the US Constitution and the US Code.
