New Amendments Following Reform of New Bankruptcy Laws

Southern District Bankruptcy Court New York

The New York Bankruptcy Court for the Southern District provides three divisional offices which serving area 14 counties. The 2003 case volume for the New York Bankruptcy Southern District was divided among the following chapters:

Jurisdiction / Coverage - The Southern District maintains offices in New York, Poughkeepsie and White Plains. The District's jurisdiction covers  the counties of Bronx, Duchess, New York, Orange, Putnam, Rockland, Sullivan, Westchester, Waters, Kings, Nassau, Queens, Richmond, and Suffolk County. In general, to qualify for filing, and individual must be a state resident for the preceding 180 days. US citizenship is not required. Property ownership may invoke the court's jurisdiction in some circumstance and be sufficient for filing.

The Southern District provides examples of form petitions, all schedules, supplemental forms, local rules and official filing instructions that may be useful. Be aware official instructions provide general information, and can not, by law, provide personal legal advice to any party in interest. Only qualified attorneys may provide legal advice and recommendations. The US Code prohibits judges, clerks and personnel to provide debtors with information that may be construed as legal counsel. This provision applies equally to debtors and creditors. Any individual filing pro se may call trustees and inquire about case status and their opinion regarding intended recommendations for the court. Representatives of the Trustee generally provide explanations to debtors by telephone of the basis of all objections filed, if any.

Daily operation and administration procedures for New York Bankruptcy Courts are determined by the Administrative Office of US Courts. The judicial power of Judges is determined by Federal Law, which is derived primarily from the US Constitution and the US Code. Additional clarification of judicial power is provided by court decisions, Federal rules, and Local Rules.
